An Act to enact the Protecting Privacy and Consumer Data Act, to amend the Personal Information Protection and Electronic Documents Act and to make amendments to other Acts
This enactment enacts the Protecting Privacy and Consumer Data Act to govern the protection of personal information of individuals while taking into account the need of organizations to collect, use or disclose personal information in the course of commercial activities. Consequently, it repeals Part 1 of the Personal Information Protection and Electronic Documents Act and changes the short title of that Act to the Electronic Documents Act. Finally, it also makes amendments to other Acts.
Bill C-36 introduces the new Protecting Privacy and Consumer Data Act, which will replace Part 1 of the current Personal Information Protection and Electronic Documents Act (PIPEDA). This new act aims to better protect Canadians' personal information while still allowing organizations to collect, use, and disclose data for commercial purposes. It establishes new rules for how businesses must handle personal data, including requirements for consent, data security, and transparency. Organizations will have new obligations regarding data breaches and will need to notify individuals and relevant authorities. The bill also introduces a data mobility framework, allowing individuals to request their data in a transferable format.
